Terms of Use

These Terms of Use ("Terms") are a legal agreement between you and Passion Media Inc. ("Passion Media," "we," "us," or "our") governing your access to and use of the Passion Media mobile app and website (collectively, the "Service").

By creating an account or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service. See also our Privacy Policy and Community Safety Standards, which are incorporated into these Terms by reference.

1. Eligibility

You must be at least 13 years old to use Passion Media. If you are under 18, you must have permission from a parent or legal guardian to use the Service. By using the Service, you represent that you meet these requirements and that all registration information you provide is accurate.

2. Your Account

• You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
• You must notify us promptly at support@passionmedia.social of any unauthorized use of your account.
• One person or legal entity may not maintain more than one account without our permission.
• We may suspend or terminate your account for violating these Terms, our Community Safety Standards, or applicable law.

3. Content You Post

3a. Your Content, Your Ownership

You retain ownership of the videos, photos, audio, live streams, comments, and other content you create or upload to the Service ("User Content"). By posting User Content, you grant Passion Media a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, distribute, display, and perform that content solely for the purpose of operating, promoting, and improving the Service. This license ends when you delete the content or your account, except where it has been shared with others and they have not deleted it, or where retention is required by law.

3b. Your Responsibility for What You Post

You are solely responsible for your User Content and represent that you own it or have the necessary rights and permissions to post it, and that it does not violate the rights of any third party or any applicable law.

3c. Prohibited Content and Conduct

Passion Media has zero tolerance for child sexual abuse and exploitation and other harmful content. Full details are in our Community Safety Standards, which you agree to follow. In summary, you may not use the Service to:

• Post content that sexualizes, endangers, or exploits minors
• Harass, threaten, bully, or impersonate others
• Post hate speech or content that incites violence
• Share non-consensual intimate imagery
• Infringe another party's intellectual property or privacy rights
• Distribute spam, malware, or engage in fraud
• Circumvent any content moderation, security, or access-control feature of the Service

We may remove content, and suspend or terminate accounts, that violate these Terms or our Community Safety Standards, and we report unlawful content — including CSAM — to the National Center for Missing & Exploited Children (NCMEC) and law enforcement as required by law.

5. Purchases and Subscriptions

Coins, subscriptions, and other paid features are purchased through Apple's App Store, Google Play, or our website, and are subject to the payment terms of that platform in addition to these Terms.

• Subscriptions automatically renew at the end of each billing period at the then-current price, unless you cancel before the renewal date through your App Store or Google Play account settings.
• Cancellation takes effect at the end of the current billing period; you retain access to paid features until then.
• Refunds for purchases made through the App Store or Google Play are handled by Apple or Google under their respective refund policies. Passion Media does not process these refunds directly.
• Prices may change; we will provide notice of any change to a subscription price before it takes effect on your next renewal.

6. Intellectual Property

The Service, including its design, features, graphics, trademarks, and underlying software (but excluding User Content), is owned by Passion Media Inc. or its licensors and is protected by intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service, or reverse-engineer it, except as permitted by law.

If you believe content on the Service infringes your copyright, send a notice to support@passionmedia.social including: a description of the copyrighted work, the location of the allegedly infringing material, your contact information, and a statement of good-faith belief that the use is unauthorized.

7. Third-Party Services

The Service may link to or integrate with third-party websites, services, or content (for example, payment processors, ad networks, or social platforms) that are not operated by us. We are not responsible for the content or practices of any third-party service, and your use of them is subject to their own terms.

8. Termination

You may stop using the Service and delete your account at any time from Settings → Account → Delete Account. We may suspend or terminate your access to the Service, with or without notice, if you violate these Terms, our Community Safety Standards, or applicable law, or if we discontinue the Service. Sections of these Terms that by their nature should survive termination — including ownership, disclaimers, and limitation of liability — will continue to apply.

9. Disclaimers

The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free, or that content posted by other users is accurate or reliable.

10. Limitation of Liability

To the maximum extent permitted by law, Passion Media Inc. and its officers, employees, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of $100 or the amount you paid us in the 12 months before the claim arose.

11. Indemnification

You agree to defend, indemnify, and hold harmless Passion Media Inc. from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from your use of the Service, your User Content, or your violation of these Terms.

12. Governing Law

These Terms are governed by the laws of the State of Arizona, without regard to its conflict of law principles, except where applicable consumer protection law requires otherwise. Any dispute arising from these Terms or the Service will be resolved in the state or federal courts located in Maricopa County, Arizona, and you consent to their jurisdiction.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms here and, where appropriate, through an in-app notification or email. Your continued use of the Service after a change takes effect constitutes your acceptance of the updated Terms.
